Arrowhead Lake Community Association Privacy Policy

 

We know you care about how your personally identifiable information is collected, used, processed, and shared by Arrowhead Lake Community Association and its subsidiary corporation Arrowhead Sewer Company, Inc. (collectively, “ALCA”, “we”, “us” or “our”).  We are committed to protecting the privacy of members, guests, and other users who use our Sites (defined below) and our services both online and offline, including, but not limited to, in connection with the Sites (the “Services”).  This Privacy Policy (the “Policy”) applies to all information gathering activities of ALCA, on and offline.  The Policy explains how we and some of the companies and businesses we work with collect, use, process, and share personally identifiable information and non-personally identifiable information you provide or we collect on Internet websites where this Policy is posted, including at our websites located at http://arrowheadca.org, http://www.arrowheadlakepa.org, and http://online-arrowheadca.org, and all other websites owned and/or operated by ALCA (collectively, the “Sites”).  The Policy also explains how we handle information provided to us or collected on platforms and/or applications we may make available on or through third-party websites or platforms, if it is disclosed to you in connection with your use, purchase or download of the application.  

 

When you use our Sites or Services, you understand and agree that we are providing a platform where you may have the opportunity to post content, such as photos, comments, and other materials ("User Content") to the Sites or in connection with the Services. 

 

Our Policy applies to all members, guests, customers, visitors, and other users who use or access the Sites or Services ("Users").  By using the Sites or the Services you agree to our Policy and consent to the collection, use, processing, and sharing of personally identifiable information and non-personally identifiable information in accordance with this Policy.  Unless otherwise noted, any changes to this Policy will take effect immediately upon being posted.  Your continued use of the Sites, any applications, and the Services after the effective date of the changes constitutes your consent to those changes to the Policy.

 

Collection of Information

 

Personally Identifiable Information:

We collect personally identifiable information ("Personally Identifiable Information") from you when you provide Personally Identifiable Information to us through the Sites or the Services.  Personally Identifiable Information is information that identifies you as an individual and may include, but not be limited to, your first and last name, ALCA home, addresses, subdivision name, Personally Identifiable Information you provide concerning family members or others, email addresses, telephone numbers, mobile numbers, fax numbers, date of birth, ages, gender, registration date, User name, password, vehicle make, model, year and license plate number, Profile Information (defined below) when you register with ALCA by creating an ALCA account (the “Account”) and any other information that identifies you.  You may provide Personally Identifiable Information when you:

 

  • Use or access the Sites or the Services;

  • Complete forms on the Sites or in connection with the Services, subscribe to any ALCA newsletters, or request any information;

  • Upload or submit any material or User Content through the Sites or the Services;

  • Register with us by creating the Account;

  • Use Personally Identifiable Information, including User Content, to create a profile and provide information requested in connection with the creation of a profile (“Profile Information”) with ALCA;

  • Participate in transactions with the Sites or the Services, including by purchasing a property within ALCA;

  • Make requests through the Sites or the Services;

  • Request information or contact us, including by email; 

  • Communicate with ALCA, for example to report a problem or to submit queries, concerns, or comments regarding the Sites or the Services or their content in which event we may send you Services-related emails (e.g., Account verification, changes/updates to features of the Services, technical and security notices);  or

  • Posting comments or information to the Sites or when you participate in discussions on the Sites.

 

Non-Personally Identifiable Information:

In addition, we collect certain non-personally identifiable information (“Non-Personally Identifiable Information”) automatically when you use the Sites or the Services.  Non-Personally Identifiable Information may include, but not be limited to, the type of device, including mobile device, you use, your Device ID (defined below), the Internet Protocol (“IP”) address of your mobile device or computer, your operating system, the type and version of your Internet browsers, your Internet service provider, Log Data (defined below), real time location information, analytics information, metadata, pages of our Sites that you visit, the time spent on those pages, any search engine you may have used to locate the Sites or the Services, and information about the way you use the Sites or the Services.

 

Device IDs: We may collect and store a unique device identification associated with your particular mobile device (“Device ID”).  Device IDs are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device.  We use your Device ID to track the number of unique Users using the Sites and to enable you to interact with and use the Sites, our Services and/or to allow us to understand how our Sites and/or Services are used.  We may link your Device ID with the technical information accessed through your use of the Sites and/or the Services which enables us to administer resets to your Account or to delete information when you request that we do so or for other administrative purposes.  Some features of the Sites and/or the Services may not function properly if use or availability of Device IDs is impaired or disabled.

 

Log Data:  We may collect information about your interaction with the Sites or the Services.  When you use the Sites and/or our Services, our servers automatically record information that your browser sends, including through Web analytics tools whenever you visit a website or service connected to the Internet (“Log Data”).  Log Data may include information such as your computer’s or mobile device’s IP address, browser type, your activities within the Sites, the webpage you were visiting before you came to the Sites, pages of our Sites that you visit, the time spent on those pages, search engine(s) and keywords you used to find our Sites, your browser add-ons, and your browser's width and height, sections of the Sites that you access, information you search for on our Sites, access times and dates, and other statistics. We use this information to attempt to provide you with a better experience, to improve the Sites, the Services, to analyze and understand how the Sites and the Services are used, and for advertising and other marketing purposes.  We may also use technologies, such as cookies and web beacons (described below), to collect information about the pages you view, the links you click and other actions you take on the Sites or through the Services. 

Analytics Information:  We use our own and third-party analytics tools to help us measure traffic and usage trends for the Sites and/or Services.  These tools collect information sent by your device or our Sites and/or Services, including the web pages you visit, add-ons, and other information that assists us in improving the Sites and/or the Services.  We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User. 

 

Cookies, Web Beacons and Similar Technology:  In order to provide better service when you return to our Sites, we may use cookies and web beacons to store your preferences and information about such things as what pages you visit, and past activity at the Sites.  We may also employ web beacons from third parties to help us compile aggregated statistics regarding the effectiveness of operations of our Sites.  Cookies are small pieces of information that are issued to your computer when you visit a website and which store and sometimes track information about your use of websites and/or services.  ALCA uses cookies to help recognize you as a repeat visitor, to improve the quality of our Sites and the Services, and to try to make your browsing experience meaningful.  When you enter our Sites, our web server sends a cookie to your computer which allows us to recognize your computer but not specifically who is using it.  By associating the identification numbers in the cookies with other customer information when, for example, you log-in to the Sites and/or the Services, then we know that the cookie information relates to your computer.  Some of the code and cookies used by our Sites and/or Services are served by us, and some are served by third parties who are delivering services on our behalf.  Most web browsers automatically accept cookies but, if you prefer, you can change your browser to prevent that or to notify you each time a cookie is set.  You can learn more about cookies by visiting www.allaboutcookies.org which includes additional useful information on cookies and how to block cookies using different browsers.  By blocking or deleting cookies used on our Sites and/or Services, you may not be able to take full advantage of our Sites and/or Services.  Web beacons - sometimes called single-pixel gifs or clear gifs - are used to assist in delivering cookies on the Sites and allow us to count Users who have visited those pages and to deliver services. 

 

Metadata:  Metadata is data providing information about one or more aspects of the data, including that associated with User Content.  For example, metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted.  Users of the Sites can add or may have metadata added to their User Content including a hashtag (e.g., to mark keywords when a photo is posted), geotag (e.g., to mark your location to a photo), comments or other data.  This metadata makes your User Content more searchable by others and more interactive.

 

HOW WE Use Your Information

 

We will use the Personally Identifiable Information to:

  • Identify you when you sign-in to your Account;
  • Administer your Account;
  • Provide you with access to the Sites, Services and to administer your inquiries;

  • Send you information we think you may find useful or which you have requested from us;
  • Present information, including about various events and our Services, to you when you use the Services that we believe may be of interest;
  • Administer your Account with us;
  • Enable us to contact you, including in response to any question you make through the Sites or the Services;
  • Analyze the use of the Sites and the Services and the people visiting to improve our Sites, the content on the Sites, and our Services; and
  • For other purposes that we may disclose to you when we request your information.

 

We also use Non-Personally Identifiable Information to help diagnose problems with our server, administer the Sites, and compile aggregate and statistical data to help design the Sites and to identify popular features on the Sites.  In addition, we gather certain navigational information about where you go on our Sites.  Any of the information we collect, including Personally Identifiable Information and Non-Personally Identifiable Information, allows us to determine which areas of the Sites are most frequently visited to provide you with a better experience, personalize your experience, improve customer service, process transactions, and improve the Sites and the Services and content and/or layout of our Sites for you and others.   

 

We sometimes use your Personally Identifiable Information in conjunction with your Non-Personally Identifiable Information.  Certain Non-Personally Identifiable Information would be considered a part of your Personally Identifiable Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified.  We may combine your Personally Identifiable Information with Non-Personally Identifiable Information and aggregate it with information collected from other Users to attempt to provide you with a better experience, improve the Sites and the Services, and analyze and understand how our Sites and Services are used.

 

OPTING OUT

INFORMATION SHARING

 

Public Disclosure:

When you create an Account, a basic profile page is created for you on the Sites, containing your Account/User name, profile image, certain Profile Information, comments, and other information that may be made available.  The Sites and the Services are used by all Users of the Sites and Services.  When a User takes certain actions on the Sites or through the Services, such as post comments, upload User Content or provide certain Profile Information, other Users of the Sites and Services can click that User’s profile to view the Profile Information.  Profile Information viewable on the Sites and through the Services will include your Account name/User name, information you elect to add, comments you posted to the Sites, and User Content you elect to upload.  Any Personally Identifiable Information or User Content that you voluntarily disclose in public areas of the Sites or through the Services become publicly available and can be collected and used by other Users of the Sites or the Services.  

 

You should exercise caution before disclosing your Personally Identifiable Information through these public venues.  Other Users are not bound to treat your Personally Identifiable Information in accordance with this Policy.  You expressly acknowledge and agree that we are not responsible for the actions of other Users with respect to any of your Personally Identifiable Information.  If you wish to stop receiving communications from any Users, please contact the User directly.   

Business Partners:

We may make certain Personally Identifiable Information and other information available to trusted third parties that work with us to provide products and services to our Users that help us with marketing campaigns, or to market products or services to you directly.  We may engage third party companies and individuals to perform certain functions on our behalf.  Examples include, but are not limited to, companies and individuals who: (i) administer our accounts; (ii) facilitate our Services (e.g., without limitation, maintenance services, database management, web analytics and improvement of our Sites or Services’ features); (iii) conduct surveys or promotional activities; or (iv) provide customer support, web hosting, internet service, and data analysis.

 

We may share aggregate information that includes non-Personally Identifiable Information and Log Data with third parties for industry analysis, including analysis of how our Sites and the Services are used.  Any aggregate information shared in these contexts will not contain your Personally Identifiable Information. 

 

TRANSFERS OF INFORMATION FOR LEGAL PURPOSES

 

ALCA may need to disclose certain information to comply with a legal requirement, such as a law, regulation, court order, subpoena, or search warrant, in the course of a legal proceeding or in response to law enforcement or other governmental agency requests or when we believe that disclosure is necessary to protect our rights.  In addition, if there is a change of control in ALCA's business (whether by merger, sale, or otherwise) or a sale or transfer of its assets (in whole or in part), your information could be sold, assigned, or transferred as part of that transaction and your Personally Identifiable Information and other information, including Non-Personally Identifiable Information, potentially used by the purchaser or other recipient of said information.

 

You acknowledge that ALCA is located in the United States of America ("U.S.") and will process and store your information in the U.S., and that as a result, U.S. governments, courts or law enforcement or regulatory agencies may be able to obtain disclosure of your information through the laws of the U.S.  If you reside outside the U.S. your Personally Identifiable Information and Non-Personally Identifiable Information will be transferred, processed and stored in the U.S. under U.S. privacy standards.

 

Your California Privacy Rights


As described above, from time to time, we make your Personally Identifiable Information available to third parties. If you do not want us to share your Personally Identifiable Information with other companies or organizations, you may opt-out of this information sharing by emailing ALCA at alcamail@epix.net, or writing to us at Arrowhead Lake Community Association, 961 Arrowhead Drive, Pocono Lake, Pennsylvania 18347, ATTN: Communications Department.  This notice is designed to comply with California's "Shine the Light" law, but the opt-out option is available to all of our Users.

 

Updating your account and contact information


You may update your Account, contact information and Personally Identifiable Information at any time by accessing your Account and updating your Account information and Profile Information, by completing and submitting to the Sites an online change request form, emailing us at alcamail@epix.net, or mailing us at Arrowhead Lake Community Association, 961 Arrowhead Drive, Pocono Lake, Pennsylvania 18347, ATTN: Communications Department, and identifying the contact information and Personally Identifiable Information you would like updated. Data Retention Policy, Managing Your Information

 

We will retain Personally Identifiable Information for as long as you use the Sites or the Services and for a reasonable time thereafter.  If you would like us to delete or modify Personally Identifiable Information that you provided via the Sites or through the Services, please access your Account and update your account information and Profile Information by removing Personally Identifiable Information, by completing and submitting to the Sites an online change request form identifying the Personally Identifiable Information you would like deleted or modified, or by contacting us at alcamail@epix.net and identifying the Personally Identifiable Information you would like modified or deleted, and we will respond within a reasonable time.  Please note that some or all of the Personally Identifiable Information may be required in order for the Sites and the Services to function properly.  You may also delete Personally Identifiable Information by deleting your Account and terminating your access to ALCA; however, ALCA may retain such information for a reasonable period of time after deletion. 

 

Children UNDER 13

 

We do not knowingly allow anyone under the age of 13 to provide us with any Personally Identifiable Information. Children should always get permission from their parents before sending any information about themselves (such as, their names, email addresses, and phone numbers) over the Internet to us or to anyone else.  In the event we learn that we have collected Personally Identifiable Information from a child under the age of 13 without parental consent, we will delete that information as quickly as possible.  If you believe we might have any information from or about a child under the age of 13, please contact us at alcamail@epix.net.

 

Mobile Devices/Third Party Fees

 

In connection with your use of the Sites and the Services, you are responsible for obtaining access to mobile device services and that access may involve third-party fees, including mobile carrier, text messaging, or airtime charges.  You are solely responsible for those fees, including any and all fees associated with the use of the Sites and the Services, delivery of the messages, emails or other materials to your mobile device.  Please consult your mobile service provider's pricing plan prior to purchasing or downloading any application or registering for any such service to determine the charges for sending and receiving text messages from/to your mobile device.  

 

Links and third party offers

 

The Sites may, on occasion, contain links to other websites with information gathering practices different from our own. Users should consult the privacy policies for all other websites, as ALCA has no control over information submitted to or collected by such third parties.

 

 

 

 

DATA Security

 

ALCA uses industry-standard encryption technologies when transferring and receiving data.  You can check whether your connection is using encryption technologies by using the functions in your browser, such as whether our page is showing as having been delivered by “https”.  We have also implemented other technical, physical and administrative security measures that protect against the loss, misuse, or alteration of information that we collected from you.  Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, the security of your data is a shared responsibility and no security system can prevent all potential security breaches. 

 

Privacy Policy Changes

 

This Policy may be updated from time to time for any reason.  We will notify you of any changes to our Policy by posting the new Policy on our Sites.  Your continued use of the Sites or the Services following a change in the Policy represents your consent and agreement to the new Policy to the fullest extent permitted by law.  We encourage you to periodically visit our Sites to review this Policy for any changes to it.

 

Consent

 

By using the Sites or our Services, you consent to our collection, use, processing, and sharing of your Personally Identifiable Information (as well as Non-Personally Identifiable Information).  When you register for an Account, engage in the Sites or the Services, post comments to the Sites, engage in transactions, communicate with us, use interactive portions of the Sites or our Services, or otherwise use the Sites or the Services, you consent to our collection of your Personally Identifiable Information (as well as Non-Personally Identifiable Information) in accordance with this Policy that you disclose or make available to us during those activities.  Your information collected through the Sites and the Services will be stored and processed within the U.S.
